IR35 latest

IR35 is with us whether we like it or not. Claims as to legality of the legislation brought by The Professional Contractors Group (PCG) were lost. However, it is encouraging that the judiciary are criticising the Inland Revenue's assessment procedure for determining the employed/self employed tests which lay at the heart of an IR35 enquiry.

To date, the Inland Revenue have not had matters all their own way and have lost a number of IR35 cases at both the Special Commissioners and High Court.

LIMITED COMPANIES

The majority of Interim Management companies are now placing only individuals who have established Limited company status. The advantage is that the consultants fees can be paid gross and business expenses can be claimed directly.
